In a collaborative divorce everyone is completely committed to reaching an out-of-court settlement, including the attorneys.
What makes collaborative divorce different than a simple out-of-court negotiation is the pledge you and your attorney make to reaching a settlement - should your divorce end up in litigation your collaborative law attorney will no longer represent you. Both you and your spouse will have a lawyer that makes the same commitment and the threat of having to start over with new counsel incentivizes resolution on all sides. Because court is taken out of the equation, agreements are not pushed by the threat of litigation - differences are resolved equitably and with respect.
Collaborative divorce promotes creative solutions and it is common to enlist the aid of outside professionals such as family therapists and financial advisers along the way. These outside professionals may enrich your divorce process by providing their expertise during difficult discussions, thus streamlining your negotiations.
